By visiting our application and/or purchasing goods from this Application owned by COFE DISTRICT APP HOLDING a Company duly organized and existing under the laws of Abu Dhabi Global Market, with registration number 000005171 (the “Company”) , you enter a legally binding agreement with Us on the following Terms of Service.

Please read these Terms of Service carefully before accessing or using our application. By accessing or using any part of this Application, you agree to be bound by these Terms of Service. You acknowledge that you understand these Terms and that they affect your rights and liabilities. These Terms of Service describe the basics for purchase by you, and sale by us, of the products, described on this application.

This Application is owned and operated by the Company and its associates, related parties, successors, and assignees/agents (collectively hereinafter referred to as “Provider”, “us”, “we” or “our”

SERVICES

All COFE App services aim to link the Users to COFE Vendors, by advertising food and beverages on behalf of the COFE Vendors. COFE App does not guarantee the quality of the food and/or beverages prepared by the COFE Vendors, nor does it guarantee that the food and/or beverages available match the information provided by the COFE Vendors displayed on the COFE App.

USER'S OBLIGATIONS

CANCELLATION POLICY

Type of Service Cancellation Policy
Pick-up Service:
  • Users will have 5 seconds from the time of placing the order to cancel their order by clicking on the cancel button in the app immediately after placing the order.
  • Users must ensure they arrive at the pick up location at the time of pick up mentioned in the statement order, if the User is not present 15 minutes after the pick up time, then the COFE Vendor reserves the right to reject replacing the order without a refund (specifically for orders that may violate health and safety, or the quality of the food and/or beverage).
  • Users must ensure to arrive at the pick up time and not before as the order will be made available at time stated.
  • If the User has requested for the COFE Vendor’s staff to deliver the order to their vehicle, then the vehicle must be parked in a legal parking zone at time of pick up, otherwise the order will be moved to the COFE Vendor’s establishment within five minutes from time of pick up and the COFE Vendor will have the right to cancel the order and no refund will be provided.
Delivery Service:
  • Users will have two minutes from the time of placing the order to cancel their order by clicking on the cancel button in the app immediately after placing the order.
  • Drivers will wait for 10 minutes at place of delivery, if the drivers are not attended to within the ten minutes then COFE App will have the right to cancel the order and no refund will be provided.
  • Delivery orders are delivered by COFE App’s service providers and COFE App is not responsible for the riders or quality of service offered through delivery.
Express Delivery:
  • Users will have two minutes from the time of placing the order to cancel their order by clicking on the cancel button in the app immediately after placing the order.
  • If the building management does not allow orders to be delivered to the floors then the user must come and receive the order from the vendor or app representative within 5 mins from delivery timing.
  • Users must only place the order if they or someone on their behalf is available to receive the order at time of delivery.

REWARDS PROGRAM

COFE App offers Brand specific customizable Rewards Program, providing redeemable reward points to its users to be used through COFE App (the under the terms and conditions as set out below.

1. Eligibility

Only COFE App Users shall be eligible to join the program. Such may be subject to change at any time. Every brand on COFE App has their own customizable rewards program that the vendor is responsible to fulfill. The User is eligible to enter the vendor reward program after placing their first order with the brand.

2. Acceptance and Disclosure

The terms and conditions set out herein, together with COFE App’s privacy policy available on its website shall govern COFE App’s relationship with users of the program including but not limited to the membership, expiration, redeeming and earning of beans.

3. Cancellation or Modification

The Brand reserves the right to modify at any time without notice including but not limited to the program benefits, awards, the program’s earning and redemption points as set in clause number 8.4 below. It is the sole responsibility of the User to remain knowledgeable of the program terms and conditions and any modifications that may occur to them. The User’s continued participation in the program will constitute the acceptance of any such modifications.

COFE App or the COFEAPP Vendor that own the reward program may cancel the program, in whole or in part, with one-week prior notice to all active users, and all unredeemed points will be lost after the conclusion of the notice period without any obligation or liability.

The Company can immediately cancel the program membership account of any user, if in its reasonable opinion the user has breached these terms and conditions, or behaved fraudulently, or has provided COFE App with false or misleading information. In the mentioned events the user will lose all the acquired benefits and any right of use.

4. Earning and Redemption

The customized brand specific rewards program allows Users to earn and redeem points when making purchase orders through COFE App, and in accordance with the rules, requirements and specifications set out below:

5. Claims; Canceled, Modified, Delayed Orders

In case of an order being canceled or modified by the User, the points earned from this order will be deducted from the users’ rewards account. In case of an order being delivered to the member after the estimated delivery time, for any reason, no additional points will be earned as result of this delay. Redemption award claims shall not be accepted for any backdated access and purchases made by the account member as a Guest.

REFUND POLICY

COFE App will provide full or partial refunds to Users under the following circumstances:

FORCE MAJEURE

Parties to the terms shall not be held responsible for a failure to perform or for improper performance caused by a Force Majeure event.

We are using a commercially reasonable level of skill and care to maintain the security of the data provided to us by the User and we hope that our User would enjoy the use of our Application Though, we maintain the highest standards of accuracy in order to maintain our credibility, but we hereby do not warrant any commitment about the content within the services, the specific functions of the services, suitability and reliability of the services to your specific needs. We make no representations, warranties, or guarantees, whether expressed or implied, that our Services or any content on our site is accurate, complete, up-to-date, or free from errors or omissions.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless District for General Trading and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

NO THIRD PARTY BENEFICIARIES

You agree that, except as otherwise expressly provided in this Terms and Conditions, there shall be no third-party beneficiaries to this Terms and Conditions, and that you may not assign your profile or registration to any other persons.

NOTICES

If you choose to provide us with a nominated email address, unless you expressly inform us otherwise, we may communicate with you by providing you with notices regarding updates, changes, or additions to the application or Services offered through or in connection with the application.

COPYRIGHT

All copyright in all material contained on, in, or available through Application are owned by District for General Trading or its proprietary holders, and you are required to abide by all copyright notices contained on the Application. There are certain logos of other brands and some photos which are being used on the Application and these might not be owned by Us. Still, the User is under obligation to abide by the copyrights of other brands and would be liable for any violation, and District General Trading hereby disclaims any liability in this regard.

CHANGE TO TERMS OF SERVICE

The User can review the most current version of the Terms of Service at any time on this page.

COFE App reserves the right, at its own sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to the application. It is the User’s responsibility to check our application periodically for changes. Your continued use of or access to our application or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

WAIVER & SEVERABILITY LAW

Our failure to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.

If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the Court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

VIOLATIONS & INFRINGEMENTS

Any violations or infringement of the Terms and Conditions should promptly be reported by the User by emailing COFE App at hello@cofedistrict.com

JURISDICTION AND GOVERNING LAW

The Terms and Conditions will be legally binding. Any dispute or claim arising will be in accordance to Abu Dhabi Global Market laws , and Abu Dhabi Global Market Courts shall have the Competent Jurisdiction.

Additional Terms For Our E-Store Users

The User acknowledge that all above general terms of services are applicable for our e-store market except for clause 3,7,8 and 9.

Certain products may be available exclusively online through the application. These products may have limited quantities and are subject to return or exchange only according to our Return Policy as defined in Return and Refund Policy for e-store section.

We have made every effort to display as accurately as possible the colors and images of our products that appear at th e-store. We cannot guarantee that your computer/mobile phone monitor’s display of any color will be accurate.

We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

Account Deletion Terms & Conditions

The Terms and Conditions on Deletion of COFE App Account (“these Terms”) governs deletion of your COFE App account and related matters.

Please read these Terms carefully before submitting an application for account deletion. If you have any questions, please contact COFE App customer service.

Your acceptance of these Terms and clicking the Submit button indicates that you have read and fully understood all the content of these Terms and indicates that you believe deleting your COFE APP account can help achieve your expected purposes.

After you submit an application for account deletion, COFE APP will check your account in accordance with these Terms and relevant instructions on the console. If your account meets the account deletion conditions, COFE APP will notify you of the result and start the account deletion process after your confirmation. This process cannot be withdrawn or revoked. If your account does not meet the conditions, COFE APP will notify you of the result and the account deletion procedure will be automatically terminated.

The checking of your account in accordance with the conditions above is preliminary and to the extent of formalities review. Compliance with the account deletion conditions does not mean that COFE APP materially accepts the result or waives any rights entitled by laws or agreements, nor does COFE APP affirm that any operations and responsibilities arising out of your account before the deletion process are exempted or mitigated, including but not limited to any overdue payments, entrusted payments, and unpaid taxes.

Cofe Subscription Terms and Conditions

These Terms and Conditions apply to you if you subscribe to COFE Subscription (the “Subscription”). These terms do not replace the general terms of use available on our application and website for your COFE App account, which will continue to apply except to the extent the following terms and conditions vary.

As a User, you may be eligible to enroll in the Subscription, whereby you subscribe to the COFE package (the “Package”) as described below, and you can avail of it through COFE App Platforms.

Cofe Subscription Terms

Your COFE Subscription is valid for 30 (thirty) days (the “Subscription Term”) starting from the day you subscribe to COFE SUBSCRIPTION.

Termination by us

We may terminate your Subscription immediately without any prior notice if we decide, in our discretion, that you violate these terms or any applicable laws, involve fraud or misuse of the Subscription, or is harmful to our interests or another user.

Cancellation

Subscription Fees are non-refundable, except if we cancel your Subscription during the Term; in this case, we will refund a pro-rata amount.

Note: Reward Program and e-gift card cannot be used and are not applicable on COFE SUBSCRIPTION.
